Seasonal Rental Agreement
1. Payment and Confirmation
A payment of 50% of the total amount due is required to confirm your reservation. The remaining balance must be paid 14 days before your arrival. Reservations made within 14 days of arrival require full payment upon signing the rental agreement.
2. Check-In and Check-Out
- Check-In: Check-in is after 4:00 PM. Upon arrival, please check the condition of the property and report any damage immediately.
- Check-Out: Check-out is by 10:00 AM. Please leave dirty linens in the laundry room, set the AC to 78°F, start the dishwasher, lock all doors and windows, and return the keys.
3. Provided Items
The rental includes bed linens, bathroom and kitchen towels, and a starter supply of paper towels, toilet paper, trash bags, dish soap, shampoo, conditioner, and hand soap.
4. Reservation Agreement
- Occupancy Limit: Only the number of guests specified in the agreement may stay. Special events are not allowed.
- Inventory: The property is inspected after each stay. Missing or damaged items will be charged to the guest.
- Access: Access instructions will be provided after full payment is received.
5. Turtle Season Guidelines (May 1 - October 31)
If staying at a Gulf-front property, you must comply with local sea turtle protection rules, including turning off beach-facing lights at night.
6. Cancellation Policy
(a) Property Unavailability:
- If the property becomes unavailable before your stay due to unforeseen circumstances (e.g., sale of property, necessary repairs, or natural disasters), the Rental Manager agrees to refund the full amount paid to date. The Guest agrees to release the Rental Manager and the Owner from any further claims or liabilities regarding the cancellation.
(b) Cancellation by Guest (More than 30 Days Before Arrival):
- Cancellation within 48 hours of reservation: Guests can cancel within 48 hours of making the reservation, as long as the cancellation is outside the 30-day period before arrival. A 3.5% fee will be applied.
- Cancellation more than 30 days before arrival: If the Guest cancels the reservation more than 30 days before the arrival date, they will receive a refund of all amounts paid, minus a 10% cancellation fee. This ensures that the Rental Manager is compensated for administrative work and lost booking opportunities.
(c) Cancellation by Guest (15-30 Days Before Arrival):
- If the Guest cancels between 15 and 30 days before the arrival date, 50% of the total payment is forfeited. The remaining 50% will be refunded to the Guest.
- This partial refund accounts for the difficulty of rebooking the property on such short notice.
(d) Cancellation by Guest (Within 14 Days of Arrival):
- If the Guest cancels within 14 days of the scheduled arrival date, 100% of the payment is forfeited. No refund will be issued, as rebooking the property at such a late stage is highly unlikely.
(e) Rebooking the Property:
- If the Rental Manager is able to rebook the property for the same dates, terms, and price as the canceled reservation, the Guest will receive a refund of all amounts paid, minus a 20% cancellation fee or $500, whichever is less.
- If the property is rebooked for a lower rate or fewer days, the Guest will be refunded the difference between the original reservation total and the rebooked amount, minus the cancellation fee.
(f) Homeowners' Association (HOA) Denial:
- If the property requires approval from an HOA and the Guest fails to submit the necessary paperwork or is denied by the HOA, no refund will be issued unless the cancellation falls within the 30-day period, in which case the regular cancellation fees apply.
(g) Cancellation Within 2 Days of Arrival:
- No cancellations are permitted within 2 days of the scheduled arrival date. If the Guest cancels within this window or fails to pay the final payment on time, the Guest forfeits all payments made, including the Reservation Deposit.
(h) Property Substitution:
- In rare cases where the property becomes unavailable due to events outside the Rental Manager's control (e.g., repairs, sale of the property, software issues, etc.), the Rental Manager reserves the right to provide a substitute property of equal or greater value. If no equivalent property is available, a full refund will be issued. However, the Rental Manager is not responsible for any additional travel or relocation expenses incurred by the Guest.
(i) Extenuating Circumstances:
- In cases of extenuating circumstances, such as global pandemics, natural disasters, or building construction, refunds will be issued at the sole discretion of My Florida Vacation Rentals. Such refunds are not guaranteed and will be assessed on a case-by-case basis.
7. Damage and Repairs
Guests are responsible for any damage or excessive cleaning required upon check-out. Unauthorized pets and smoking will result in additional charges.
8. Pets
Pets must be pre-approved, and a nonrefundable fee applies. Pets must be leashed, and all pet waste must be cleaned up.
9. Smoking
Smoking is strictly prohibited indoors. A fee of $250 will be charged for any violations.
10. Eviction
Violation of occupancy limits, smoking rules, or pet policies may result in immediate eviction with no refund.
11. Liability
Guests assume responsibility for injuries or damage that occur during their stay.
12. Casualty or Destruction
In the event the property becomes uninhabitable due to an Act of God or other disaster, payments will be refunded on a pro-rated basis.
13. Swimming Pool/Spa
Guests use the pool at their own risk and must comply with all safety rules. No diving is allowed.
